A housewife, Mrs Maryanne Mgbeahuruba has appealed the judgement of a Magistrate court sitting in Lagos in an alleged domestic violence case between her and her estranged husband, Mr. Samuel Ifeanyichukwu Mgbeahuruba.
The appeal was filed following a consent judgment that allegedly favored the estranged husband in a domestic violence case.
The Appellant is citing lack of fair hearing in the judgment involving the contested ownership of a two-storey building located at 19, Olatunji Idowu Street,Off Ago – Palace Way, Okota, Isolo, Lagos state which was delivered by Chief Magistrate, Mrs. Balogun L.Y.
The case, initiated by the Inspector General of Police, centers on criminal charges against Mr. Samuel Ifeanyichukwu Mgbeahuruba, accused of domestic violence against Maryanne.
However, the consent judgment, delivered on December 20, 2023, awarded part of Maryanne’s building to her estranged husband, instructing her to vacate by January 8, 2024.
Mrs Maryanne, claimed that she was not represented by her lawyer, Mr Bartholomew Ajagbo, the day she was summoned into the Magistrate’s Chamber for ‘ discussion ‘, that gave birth to the contested Consent Judgement, whereas the husband and his lawyer were fully represented.
She stated that her right to speak her mind despite her protest was denied while expressing shock and surprise to see the purported court consent judgement sharing and assigning three flats , part of the penthouse of her building, that she built with bank loan ,to her estranged husband, with instructions that she must vacate to another apartment and report for compliance on January 8, 2024.
