Appeal Court Upholds Uba Sani’s Victory in Kaduna , Francis Nwifuru’s Election in Ebonyi

The Abuja Division of the Court of Appeal has upheld the victory of Uba Sani of the All Progressives Congress (APC), in the March 18 gubernatorial election in Kaduna State.

A three-member panel of Justices of the Appellate court, in a unanimous judgement on Friday, upheld the decision of the Kaduna State Governorship election Petition Tribunal, which dismissed the petition, filed by the Peoples Democratic Party (PDP) and its candidate, Isah Ashiru, challenging the victory of Sani in the gubernatorial poll.

The Tribunal, led by Victor Oviawie, in a virtual judgement delivered via Zoom on September 28, held that the pre-hearing notice of the PDP and its candidate was filed out of time and, therefore, deemed to be abandoned.

Justice Oviawe, however, noted that if the petition had not been dismissed for lack of merit, the tribunal would have ordered a supplementary election in 22 polling units within 90 days of the substantive judgement.

The Independent National Electoral Commission (INEC), declared Uba Sani, the winner of the March 18 gubernatorial election in Kaduna State after he polled 730,001 votes to defeat his closest rival Ashiru of the PDP, who scored 719,196 votes.

Meanwhile, the Lagos Division of the Appellate Court has also affirmed the electoral victory of Francis Nwifuru of the All Progressives Congress (APC) in the March 18 gubernatorial election in Ebonyi State.
