Bamise: Court to Hear BRT Driver Application of No-Case Submission February 8

A Lagos State High Court sitting at Tafawa Balewa Square has scheduled February 8 for the adoption of no case submission filed by the defense counsel in the on-going trial of a BRT driver, An­drew Nice Ominikoron, who allegedly raped and murdered a 22-year-old fashion designer, Bamise Ayanwole.

The court presided by Justice Sherifat Shonaike was told by the state prosecutor M. A Olateju that the defense counsel at the last sitting, hinted the court that he would be filing a no-case submission.

However, Abayomi, from the Abay­omi Omotubora chambers, told the court that the reason why the prosecution has not been served was because the filing has not been completed.

“We need a little time in order to com­plete filing. All that is left to be done is just scanning and that will be done as soon as possible,” Abayomi told the court.

Olateju however, suggested a further date to enable the defense to file it’s no-case submission properly.

Justice Sonaike after taking submis­sions from counsels adjourned the mat­ter till February 8, 2023 for the defense to adopt its no-case submission.

Ominnikoron, 47, is facing a five-count charge of rape, conspiracy, felony, sexual assault, and murder preferred against him by the Lagos State Government.

According to the charge, the incident occurred on February 26, 2022, at about 7pm, near the Lekki- Ajah Conservation Centre, Lekki-Ajah Expressway, Lagos.

The prosecution alleged that the de­fendant had forceful sexual intercourse with Oluwabamise Ayanwole, before murdering her.

The alleged offences were said to con­travene Sections 411, 223, 260 and 165 of the Criminal Law of Lagos State, 2015.

Ominnikoron had however pleaded not guilty to the charge.
