An Abuja based lawyer, Ebenezer Amadi has instituted an action before Federal High Court Abuja against Blue Ridge Microfinance Bank LTD popularly known as Okash for violating his Right to Privacy by collecting his telephone number without his consent and calling him consistently on phone using automated teller caller from 16 July 2024 till date for the purpose of marketing their loan service to him.
The parties joined in the suit are Nigeria Data Protection Commission, NITDA, NCC and FCCPC.
Among the reliefs sought is:
“A DECLARATION that the actions of the 1st Respondent consistently calling the telephone number of the Applicant 08061194337 from the 16 of July 2024 till date using automated telephone calls without his consent is a gross and brazen violation of the Applicant’s Fundamental Human Right to Privacy, as enshrined under section 37 of the Constitution of the Federal Republic of Nigeria 1999 (as Amended).”
He is claiming the sum of N200,000,000 for his fundamental right to privacy infringement.
