A Federal High court sitting in Birnin-Kebbi, Kebbi State, has nullified the election of Senator Adamu Aliero as the Peoples Democratic Party’s candidate for Kebbi Central Senatorial Zone in the forthcoming 2023 general elections.
The court ordered the Independent National Electoral Commission (INEC) to substitute Aliero’s name with Haruna Saidu, as the substantive PDP candidate for the senatorial zone poll in 2023 elections.
The presiding Judge, Justice Babagana Ashigar, who delivered the judgment, said Aliero was not validly elected in line with the provisions of the Electoral Act 2022.
Justice Ashigar, said the court nullified the primary election conducted in the state by PDP in May because it was married by irregularities.
He stated that PDP did not give fair hearing to Haruna Saidu following a petition on allegation of forged signatures.
The judge also said INEC unlawfully excluded the plaintiff’s name (Saidu) from the primary won by Aliero when he (Saidu) had won the first primary election.
Justice Ashigar further held that Saidu having won the first primaries for Kebbi Central, the second primaries, which Senator Adamu took part in, was a nullity and Haruna remains the valid candidate for PDP Kebbi Central Senatorial District.
The judge however noted that Aliero has the right of appeal to the Court of Appeal and the Supreme Court if he was not satisfied with the court’s judgment.
