Sharia Court Acquits Jigawa Commissioner of Alleged Infidelity
An Upper Shari’a Court sitting in Kofar Kudu, Kano State, has dismissed allegations of adultery against the suspended Jigawa State Commissioner for Special Duties, Auwal Sankara.
The case, filed by Nasiru Buba, accused Sankara of having an illicit relationship with his wife, Tasleem Baba Nabegu.
However, Presiding Judge IbrahimYola struck out the matter for lack of evidence, relying on reports from the Assistant Inspector-General of Police, Zone I, and the Kano State Attorney General.
In his judgement, Yola stated that thorough investigations by the police and the Attorney General’s office revealed no evidence to substantiate the allegations.
He relied on Section 211 of the 1999 Constitution (as amended) and Section 364 (5) of the Administration of Criminal Justice Law (ACJL) 2019 to terminate the case.
“The police report and the Attorney General’s submission made it clear that the allegations of an illicit affair were baseless. As such, there was no justification to proceed with the case,” Yola said.
The judge also noted the absence of the complainant, Nasiru Buba, and his legal representation during the proceedings.
“There is no need for me to hear from the complainant since my action to terminate this case is based on the investigation report and Attorney General’s findings,” he added.
In his ruling, Yola cautioned officials of the Kano State Hisbah Board and other law enforcement agencies to exercise professionalism and avoid actions that could defame individuals.
He emphasised the importance of adhering to constitutional mandates and urged against overreach in cases that could damage public reputations.
