Supreme Court Quashes APM’s Appeal Against Fubara

The Supreme Court, on Monday, dismissed the appeal filed by the Allied People’s Movement challenging the victory of Siminalayi Fubara as governor of Rivers State.

The five-member panel, led by Justice Kudirat Kekere-Ekun, also chose to defer judgment on the appeal presented by the All Progressives Congress (APC) and its candidate, Patrick Tonye-Cole.

During the proceedings, Innocent Kere, the counsel for the Allied People’s Movement and its candidate in the March 18 election, opted to withdraw the appeal, resulting in its dismissal by the apex court.

Meanwhile, the appeal filed by Patrick Tonye-Cole and the APC was reserved for judgment after the court heard arguments from the parties involved.

Among the issues raised, Tonye-Cole contends that Fubara should be removed as governor due to his alleged failure to resign as the Accountant General of the state within the constitutionally mandated deadline and according to the Electoral Act.

The lower courts had previously dismissed all appeals against Fubara and upheld his election.
